NHS PAY 2022
 
ENGLAND
 
 
1.    What is the pay offer? 
 
The Government in England have announced that they will follow the PRB recommendation of £1,400, enhanced to 4% for top of Band 6 and all of Band 7 on Agenda for Change, backdated to 1st April 2022.
 
2.    When will this be paid? 
 
It is expected that it will be paid in September 2022, with back pay in October 2022, although this has not yet been confirmed.
 
The Government, in choosing to use the PRB process, do not have to obtain the assent of trade unions before implementation and this pay award will be paid to you, regardless of whether union members want to accept the offer or not. This is not a pay negotiation, it is an imposition of what the Government think you are worth. If you want to challenge this and continue the fight for pay justice, you need to vote against the pay award and for industrial action. If a majority of GMB members vote for industrial action in this consultative ballot, we will look to move to a formal postal ballot for industrial action as required by law. YOU MUST VOTE IN BOTH BALLOTS. If we secure mandates for industrial action, we will endeavour to align that action with other health unions who also secure action mandates.
 
3.    The pay increase was due from April 2022, will it be back-dated? 
 
Yes. The pay offer will be back dated to 1st April 2022. It is expected that back pay will be paid in October 2022.
 
4.    Who will receive the pay award? 
 
All staff directly employed on Agenda for Change Contracts working in NHS Trusts and Ambulance Services in England, Wales & Northern Ireland. 
 
5.    Who doesn’t this apply to? 
 
It does not apply to NHS Employers in Scotland due to the Scottish Government negotiating on pay with health unions this year. 
 
It also does not apply to workers employed by NHS contractors, private employers or wholly owned subsidiaries who do not follow Agenda for Change Terms & Conditions – unless they have transferred from an NHS Trust and retained their Terms & Conditions under a TUPE transfer. 
 
6.    I work for a private employer, or Wholly Owned Subsidiary; how can I know if this applies to me? 
 
The pay award does not apply to workers employed by private employers, including Wholly Owned Subsidiaries, who do not follow Agenda for Change Terms & Conditions – unless they have transferred from an NHS Trust and retained their Terms & Conditions under a TUPE transfer.

8.    What about part time workers? 
 
The £1400 will be applied to the full time equivalent salary and therefore will be pro-rata. The 4% for top of band 6 and all of band 7 will be applied to the salary.
 
9.    How will my pension be affected? 
 
Percentage increases are pensionable (and subject to National Insurance and tax). An increase in pay may result in changes to your NHS pension contributions.
 
In October 2022, there will also be changes to the NHS Pension Scheme which may some people’s contributions change. Some employees will see their contributions increase. Some part time employees may see their contributions decrease as the new contribution rates will be based on what an individual actually earns each year, rather than what they would have earned if they had worked full time.

10. What’s the schedule for GMB’s consultative ballot? 
 
The ballot will open on: Tuesday 30th August 2022 and closes at Noon on: Tuesday 27th September 2022.
 
GMB Union ensures all members have a say on their pay.  
  
Any ballot papers received after this date will not be valid. Spoilt ballot papers will not be counted.
 
Only members of GMB union are allowed to vote. 
 
 
11. What is GMB recommending? 
 
This pay award is in fact – just another pay cut. GMB believes you’re worth more. But do you?
 
This is your chance to Have Your Say on Your Pay. A vote to save your living standards. Don’t miss it. Your vote is crucial.
 
This pay award will be paid to you, regardless of whether union members want to accept the offer or not. 12. What is a consultative ballot? 
 
This is a consultative pay ballot only for you to inform GMB whether you would be willing to participate in industrial action and continue the campaign for pay justice.
 
If the majority of GMB members vote to reject the pay award and for industrial action a formal postal ballot for industrial action will happen as is required by trade union legislation. You must vote in both ballots.
 
13. What is meant by industrial action?
 
Trade unions always try to resolve disputes through negotiation. But when that doesn’t work, industrial action may be needed as a last resort.
 
The industrial action you probably hear most about is going on strike. But there are other actions workers can take, such as picketing, go-slows, overtime bans and work to rule. 
 
In Britain, the right to strike is governed by complex and restrictive industrial action laws. In summary, to count as ‘protected industrial action’, a strike must:
In addition, strikes involving workers who provide what the government calls an “important public service” can only be lawful if at least 40% of the workers balloted over the action vote in favour of it.  
 
 
Every vote counts. Every vote not cast, is a vote in favour of accepting that what the Government are paying you is what you deserve. It is crucial that you do use your vote. A vote for action at this stage does not mean that you will automatically have to take any form of action at this time.
 
But this is your opportunity to let Government know exactly how you feel about what they have done. If we receive a strong enough vote in favour of possibly taking action, from the majority of our members, we will be in a position to move to a formal ballot for industrial action and try to influence Government to reconsider and offer you something that really does recognise your true value.
 
15. Am I allowed to take part in strike action, or action short of a strike if
I am a Nurse, Paramedic or other registered healthcare professional?
 
Yes – you have the right to take part in lawful industrial action.
 
The Health Care Professions Council (HCPC) and The Nursing & Midwifery Council (NMC) both have advice regarding this on their websites.

The code of practice will remain in place during any such action and registrants have a duty to uphold their professional standards at all times.
 
16. What protections are in place for patients if we go on strike?
 
Some members may be exempted from participating in industrial action if they are “derogated to work” because their role or service is safety critical. Members who remain on duty because they are derogated. May be asked to wear badges to indicate that they are supportive of the strike.
 
17. Can I be sacked if I go on strike?
 
No – you have the right to take industrial action and you can’t be legally forced to stay at, or go back to, work (unless a ballot wasn’t organised properly).
 
If you take industrial action, you’ll probably have broken (be ‘in breach of’) your employment contract and your employer is unlikely to pay for the work you didn’t do when you took industrial action.
 
However, if you take industrial action, your employer will reduce your length of service with them by the number of days you were on strike. This is important when working out your pension and things like statutory redundancy pay.
 
18. What questions will be on the ballot paper? 
 
The Government think that you’re worth £1400 or 4% for those at top of Band 6 and all of Band 7. GMB thinks you’re worth more. 
 
The Government will pay this pay award. The campaign for pay justice can only continue with a vote for industrial action.

19. How do I vote?

20. What do I do if I haven’t received a ballot paper? 
 
Each GMB region is running their own consultative ballot, so ballot papers will be issued in a variety of ways, including online, workplace ballots and postal methods. 21. I’m not a GMB member, can I vote? 
 
Only GMB members can have a vote.

22.   What happens after the ballot closes? 
 
Once the ballot closes, your NHS National Advisory Group and National Ambulance Committee will meet to consider the results and determine the next steps in this campaign. If a majority of GMB members have voted for industrial action, a second formal ballot for industrial action will follow. This is a requirement by law. Members will need to vote in both ballots. You should hear more about this in October 2022.
 
If we obtain formal ballot mandates for industrial action, GMB will make every effort to coordinate action with other unions.

Steve Barclay’s insulting comments about the nation’s NHS staff are wildly out of touch with reality and the people of our country, says GMB Union 
This dispute could be solved if the Government does the sensible, grown up thing and starts to talk pay now, rather than deliberately smear ambulance workers who look after public.

The package includes the creation of 500 new jobs.
GMB Union have today welcomed the news that manufacturing giant JCB have agreed a significant pay boost for members at the firm.
After weeks of campaigning and negotiations with the company, workers will now receive a 10% pay rise along with a £2500 cash payment for all workers in the group, including agency staff.
The outcome includes the creation of 500 new permanent jobs through the JCB agency provider Global Guidant.

GMB union have today welcomed news that company top brass at South Staffordshire Water have conceded to union demands to protect recognition for GMB at the company.
As part of recent organisational changes at the company, involving employees passing from South Staffordshire Water to Doocey Group, union representatives had warned of risks to the recognition as well as key staff benefits such as death in service payments.
Union members at the Council have launched the campaign to end historical underpayment of women workers.
GMB Union members have this week begun a dispute with Coventry City Council over significant concerns regarding the valuing and payment of roles at the authority.
These roles, predominantly low paid and undertaken by women, form the backbone of essential Council services. Despite this they have been consistently overlooked for pay-boosts compared to roles predominantly undertaken by male workers.
The NHS is on life support; this Government have the cure, but they are refusing to use it
Workers at the plant have accepted a 20% pay offer after weeks of campaigning.
Members of GMB trade union at Walsall based firm CNC Speedwell have today confirmed they have accepted an offer on pay worth more than 20% for workers at the plant.
The outcome comes after weeks of campaigning and a ballot of members at the plant, which produces cast metal components for vehicles and machinery.
The pay offer accepted includes a 20% uplift in pay, improvements in sick pay, additional annual leave and a Christmas bonus.
Workers, who also make Clubs and Twiglets, secured 6.5 per cent backdated pay and a bonus
